The Monaco sporting community and practitioners such as our Firm have been waiting for a legislative framework for sporting events taking place in Monaco. On 12 December 2023, a draft bill n°1088 has been introduced before the Monaco Parliament. Although it does not address a number of practical issues, this draft bill is more than welcome given the organization of major international competitions in Monaco such as the Monaco Grand Prix in motorsports, the Monte-Carlo ATP Masters 1000 (held on French territory) in tennis, etc. The Principality of Monaco is also the home of many international sporting federations regulating events taking place internationally as well as in Monaco and subject to Monaco law.
The draft bill on Monaco Sports Law aims to set out a coherent, global and protective sport legislation in Monaco. The draft bill has 9 major sections:
- institutional players in sport, public and private bodies involved in the administration and organization of physical and sporting activities;
- sport in schools;
- top-level sport;
- medical monitoring of athletes;
- fight against doping, including animal doping;
- sports facilities and equipment;
- sporting events;
- teaching sport for remuneration;
- specific activity of sports agents.
DL Corporate & Regulatory has assisted Sports Federations and Clubs in Monaco (such as the Automobile Club de Monaco) for over 20 years and has been involved extensively in organization agreements, TV and media rights, sponsorship agreements, licensed video games and merchandise, sui-generis rights etc. Our Firm has continuously been named Monaco Sports Firm of the Year in Monaco and again has been honoured with this title recently.
We are monitoring closely the progress of this new draft bill. We would be pleased to discuss issues relating to this new law and/or other questions on Monaco Sports Law in connection with new 2024 projects.
