Administrative Law changes: authorisation of administrative surveillance

On 13 July 2016, a new Law n°1.430 for the protection of national security authorises the Monaco Authorities to undertake administrative surveillance in Monaco through voice recordings. The new system is destined to enable the Monaco Police to monitor, through information and interception technologies, any person presenting a threat against strategic and fundamental interests of the Principality, organised crime and terrorism. The procedure involves a request to the Minister of State and review by an independent Commission composed of 3 members within 48 hours with final say by the President of the Supreme Court.  Monitoring can also be done at the request of foreign countries.
